General terms and conditions for Holiday House Chalupa Nemojov - Starobucké Debrné č.p. 198, Nemojov, 544 01
1. Establishment of contractual relationship
These General Terms and Conditions define the mutual rights and obligations of parties arising in connection with an accommodation agreement between the Landlord and the Accommodated person via the Internet.
The contractual relationship between the Interested Party (hereinafter referred to as The Accommodated person) and the owner of house No. 198 in Nemojov - Starobuckém Debrné, postcode 544 01 (hereinafter referred to as the Landlord) is governed by the provisions of the Civil Code and these General Terms and Conditions.
The contractual relationship arises by sending a reservation to the Landlords and paying the reservation deposit.
2. Subject of the contract
The subject of the contract are the rights and obligations of the parties in the provision of temporary accommodation to the Accommodated person and represented persons by them in the premises of the Holiday House Chalupa Nemojov - Starobucké Debrné č.p. 198, Nemojov, 544 01, including garden, swimming pool and parking spaces, for the purposes of a proper and undisturbed time-bound recreation.
3. Reservations, ordering and payments
The reservation deposit is 50% of the total price for accommodation in the Holiday house. By paying this deposit the Accommodated person gains right to book accommodation in the Holiday House.
The Supplement - the amount remaining to be payed up to the total price for accommodation in the Holiday House, cannot be paid later then 6 weeks before the starting date of the accommodation in the Holiday House according to the confirmed reservation.
If the accommodation is not paid within this period, the reservation deposit lapses on behalf of the Landlord, who is entitled to offer the Holiday House for accommodation.
When ordering accommodation less than 6 weeks before the starting date of the accommodation in the Holiday House, a reservation deposit and a supplement must be paid at the same time.
4. Cancellation conditions
The Accommodated person is entitled to cancel the reservation and accommodation contract only in writing.
If the accommodation contract is cancelled within 6 weeks before the starting date of the accommodation in the Holiday House, the Accommodated person is bounded to pay the Landlord a cancellation fee 50% of the total amount, in this case the full amount of reservation deposit will be used.
If the accommodation contract is cancelled after 6 weeks before the starting date of the accommodation in the Holiday House, the Accommodated person is bounded to pay a cancellation fee 100% of the total price for accommodation.
The date of
cancellation of the accommodation is considered to be the date of delivered
written proof of cancellation.
Written proof of cancellation can be sent to the Landlord via e-mail to the address specified in the contacts.
Departure of the Accommodated person before the end of the term of accommodation does not give the right for refund of relative amount from the price paid for accommodation in the Holiday House.
5. Arrival, departure, bail
The Holiday House is available for the Accommodated person on Saturdays from 16:00 hours (unless arranged otherwise in advance).
The time of arrival and handover must be between 16:00 and 18:00.
It is necessary to contact the Landlord, approximately 1-hour prior the arrival, on the phone and arrange the exact time for handover of the house with him.
It is also necessary to contact the Landlord on the phone in case of delay and impossibility of arrival by 18:00, to inform him about this situation.
During handover the Accommodated person will pay a refundable deposit of CZK 3,000 to the Landlord in cash, which serves as a deposit for coverage damage caused by loss or damage to belongings.
Bail will be refunded to the Accommodated person during handover undamaged subject of the contract upon the departure.
In case only persons under the age of 18 are accommodated in the house without an adult supervisor, the refundable deposit is CZK 10,000.
On the day of departure (usually Saturday), it is necessary to leave the Holiday House by 10:00.
It is necessary to contact the Landlord, at least a day before departure, about the exact time of departure and handover of the house.
By mutual agreement between the Landlord and the Accommodated person, the time of handover of the Holiday House can be changed.
6. Price for accommodation and services
The prices for accommodation and services are stated in the price list, which is published on the www.chalupanemojov.cz website.
The following items are included in the price:
consumption (including electric heating)
- water consumption
- use of sheets, towels and dishtowels
- use of all electrical items located in the house
- outdoor pool
- Wi-Fi internet connection
- tourist tax
7. Liability and complaints
The Landlord is responsible of providing accommodation in the Holiday House in standard quality and of the truthfulness about the provided information's.
The Accommodated person is authorized to make a complaint only during the period of validity of the lease agreement.
In the time of the complaint, a record must be made between the Accommodated person and the Landlord. This record must be part of a complaint otherwise the complaint is not valid.
In case of violation general terms and conditions - for example: putting false information's in reservation (like number of persons, pets, etc.), the Landlord is entitled to immediately terminate the contract, and to deny access to all persons in the house together with the Accommodated person.
Similarly, the Landlord is entitled to proceed in the events of continued or outrageous violation of obligations under generally binding legislation (for example: damage to foreign property, harsh disturbing of the night's peace).
The landlord is not responsible for caused damages, for example: the destruction or theft of property during the stay in the Holiday house.
The landlord is not responsible for any injury or other harm caused by using the Holiday house. The stay and movement of persons throughout the Holiday House and in all its premises, including related land, is exclusively at their own risk of all guests and at their full responsibility, except in cases, proven to be man-made by the Landlord.
8. Other arrangements
Smoking is strictly prohibited in the indoor areas of the whole house. In case of violation this prohibition the Landlord is entitled to deny access to all persons in the house together with the Accommodated person without refunds. The landlord is entitled to perform a random check of the house during the time of accommodation.
The Holiday House is handed over and taken over tidy and cleaned. Basic cleaning is always done by the Accommodated person. If excessive mess and fouling are to find in the house at handover to Landlord, the Accommodated person will pay a cleaning fee 1.500, - CZK to the Landlord.
The Holiday House is insured according to the usual conditions for real-estate insurance (fire, flood, etc.). Insurance does not cover intentional or unintentional damage of the Property of the Landlord.
We recommend the Accommodated person take out travel insurance with liability cover for damages before their arrival.
The Accommodated person is fully responsible for the damage to the house and its equipment caused by him or other guests. The Accommodated person is obliged to report any damage and pay up this damage to the Landlord.
A record must be made between the Accommodated person and the Landlord about the damage, it will be signed by the Accommodated person and the Landlord. The record will describe the damage and will determined its expected amount. For the record a photo documentation will be taken.
The Accommodated person is obliged to provide the Landlord maximum cooperation in the matter of reporting damage to the insurance company and the elimination of consequences.
10. Personal Data
By sending a completed order via a form on the www.chalupanemojov.cz or by e-mail, The Accommodated person confirms consent to handling of his personal data for the purposes of register the Accommodated person, as well as for accounting purposes within the meaning of the tax laws of the Czech Republic.
At the same time, the Landlord is entitled not to provide personal data of the Accommodated person to third party.
Upon an arrival, a record is made in the book of guests on the basis of a valid identity document (ID card or passport), which each of the guests is obliged to submit upon the request. Persons who refuse or cannot prove their identity will lose their right for accommodation and refunding of costs.
11. Final provisions
These general terms and conditions shall take effect on 1.12.2019 and are an integral part of the contractual relationship between the Accommodated person and the Landlord of the Holiday House.
The Accommodated person is obligated to the Landlord by completing and sending an order or confirmation of reservation, and is also confirming that he had read the general terms and conditions, that he is familiar with these general terms and conditions, and he agrees to these terms and conditions. These general terms and conditions are published on the website www.chalupanemojov.cz .
